Agreement to these terms
Please read these Terms and Conditions carefully before booking a consultation, placing a deposit, or making a purchase with Stara Designs Inc. ("Stara Designs," STARA,” "we," "our," or "us"). By proceeding with a consultation, paying a deposit, or purchasing a piece, you agree to be bound by the following terms.
These Terms and Conditions are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada.
1. Bespoke nature of our work
All pieces created by Stara Designs are fully custom and made to order. Each piece is designed and crafted specifically for the individual client based on their personal instructions, preferences, and approved design.
Because every Stara piece is bespoke and made to your specifications, it is exempt from general return and exchange provisions that apply to standard retail goods under Canadian consumer protection legislation. Please read our cancellation and return policies carefully before proceeding.
2. Consultations
Initial consultations — whether in person or virtual — are offered free of charge and with no obligation to proceed. A consultation does not constitute a contract or commitment on either party's part.
Once you decide to proceed and a deposit is received, the terms below come into effect.
3. Deposits
A deposit is required before production begins. The deposit amount will be confirmed in writing at the time of your consultation and will form part of your total project price.
- Deposits are non-refundable once design work has commenced, as design, stone sourcing, and production time costs are incurred immediately upon confirmation.
- If you cancel before any design work has commenced, we may, at our sole discretion, provide a partial or full refund of your deposit.
- Your deposit will be applied in full toward the total price of your completed piece.
- Payment of a deposit constitutes your acceptance of these Terms and Conditions.
4. Pricing and final payment
All prices are quoted and charged in Canadian dollars (CAD) unless otherwise stated. Pricing is confirmed in writing at the time of your consultation.
The remaining balance (total price less deposit) is due in full prior to delivery or collection of your completed piece. We accept the following payment methods: e-transfer, credit cards, debit, cash, cheques.
Stara Designs uses secure, third-party payment processing. We do not store your full credit or debit card details on our systems.
5. Applicable taxes
All prices are subject to applicable Canadian federal and British Columbia provincial taxes (GST/PST) as required by law. Taxes will be clearly identified on your invoice.
6. Design approval
Before production begins, you will be presented with CAD design renderings for your review and approval. By providing written approval of the final design (by email or other written communication), you authorise Stara Designs to proceed with production based on that approved design.
Any changes requested after written approval has been given may result in additional charges and timeline adjustments, which will be communicated to you in writing before we proceed.
7. Cancellations
If you wish to cancel your order after your deposit has been paid:
- Before design work has commenced: We may, at our discretion, refund part or all of your deposit. Please contact us as soon as possible.
- After design work has commenced but before production: Your deposit will be forfeited to cover design and administrative costs already incurred.
- After production has commenced: Your deposit will be forfeited, and additional charges may apply to cover materials and labour already invested in your piece. These charges will be communicated to you in writing.
8. Timelines
Estimated completion timelines are provided in good faith at the time of your consultation and are based on design complexity and current stone sourcing availability. They are not guaranteed completion dates.
Delays may occur due to stone sourcing lead times, production complexity, or circumstances beyond our reasonable control (including supplier delays, shipping disruptions, or force majeure events). We will inform you promptly of any material changes to your expected timeline.
Timeline delays do not entitle the client to cancel the order or receive a deposit refund unless the delay is unreasonable in the circumstances and we are unable to provide a revised completion date acceptable to both parties.
9. Delivery and risk of loss
Completed pieces may be collected in person at our Kelowna studio or delivered by secure, insured courier. Delivery terms, estimated shipping times, and any applicable shipping charges are set out in our Shipping & Returns policy.
Risk of loss or damage to your piece transfers to you upon: (a) in-person collection from our studio, or (b) confirmed delivery by our courier to your specified address.
We strongly recommend that you arrange personal jewellery insurance upon receipt of your piece.
10. Returns and defects
Because all Stara pieces are made to your personal specifications, we do not accept returns or offer exchanges on completed bespoke pieces, except in the case of a confirmed manufacturing defect.
If you believe your piece has a manufacturing defect, you must contact us within 14 days of receipt at hello@staradesigns.ca. We will assess the piece and, if a manufacturing defect is confirmed, we will repair or replace it at no cost to you.
The following are not covered under our defect policy: normal wear and tear, accidental damage, loss, damage caused by improper care or storage, or any alterations made by a third party.
11. Craftsmanship warranty
Stara Designs provides a 12-month limited warranty on craftsmanship from the date your piece is delivered or collected. This warranty covers manufacturing defects in workmanship and structural integrity.
This warranty does not cover: normal wear and tear; accidental damage; damage caused by improper use or storage; loss of stones due to damage or improper wear; or repairs or alterations carried out by any party other than Stara Designs.

12. Intellectual property
All designs, sketches, renderings, concept illustrations, and creative work produced by Stara Designs remain the intellectual property of Stara Designs until full and final payment for your piece has been received.
You may not reproduce, share, publish, or otherwise use any Stara Designs design materials without our written consent. Upon receipt of full payment, you receive ownership of the physical piece; design rights remain with Stara Designs unless otherwise agreed in writing.
13. Limitation of liability
To the maximum extent permitted by applicable law, Stara Designs' total liability to you in connection with any order shall not exceed the total amount paid by you for that order. We are not liable for indirect, incidental, consequential, or punitive damages of any kind.
Nothing in these terms limits liability for fraud, personal injury caused by our negligence, or any other liability that cannot be excluded under applicable Canadian law.
14. Governing law and disputes
These Terms and Conditions are governed by and construed in accordance with the laws of the Province of British Columbia and the applicable federal laws of Canada. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of British Columbia.
We encourage clients to contact us directly in the first instance to resolve any concerns before pursuing formal proceedings.
15. Changes to these terms
We may update these Terms and Conditions from time to time. The current version will always be posted on this page. Your continued use of our services or website constitutes acceptance of any revised terms. We recommend reviewing this page before placing a deposit or order.
